BirdieVision, Inc. (“BirdieVision,” “us,” “our,” or “we”) respects your privacy and is committed to protecting it through our compliance with this policy.
This policy (together with our Terms of Use and End User License Agreement (“EULA”) and any other documents referred to in it) describes the personal information that we collect from you, or that you provide to us on this website www.birdievision.ai and any other website on which we display this policy (our “Website”) or through the software provided by BirdieVision for use on mobile devices (our “App” and, together with the Website, our “Services”) and how that information may be used or disclosed by us.
By visiting or using our App, Website or any other linked pages, features, content, or other services we offer from time to time by in connection therewith in any manner, you acknowledge that you accept the practices and policies outlined in this privacy policy, and you hereby consent that we will collect, use, and share your information in the following ways.
What Does this Privacy Policy Cover?
This privacy policy covers our treatment of personally identifiable information ('personal information') that we gather when you are accessing or using our Services. This policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.
The Services may contain features or links to websites and services provided by third parties, and the Services may be made available via third party platforms/marketplaces, such as Apple’s App Store. Any information you provide on third-party sites, services or platforms/marketplaces is provided directly to the operators of such services and is subject to those operators’ policies, if any, governing privacy and security, even if accessed through the Services. We are not responsible for the content or privacy and security practices and policies of such third parties. We encourage you to learn about third parties’ privacy and security policies before providing them with information.
This privacy policy also does not apply to information we collect through any other means than those described above, or to information collected on any other Company, affiliate or third-party site or by any third-party application or website that we may link to or that may be accessible from the Services.
Children’s Privacy
We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register for the Services (as that term is defined in our EULA) without obtaining parental consent. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible.
What Information Does BirdieVision Collect?
Information You Provide Us
When you use the Services, we may collect information about you, including name, video and/ or audio content, email address, mailing address, mobile phone number, your date of birth, gender, performance statistics, geographic area, self-reported golf proficiency or swing attributes, or preferences and we may link this information with other information about you. You may provide us with information in various ways on the Services. For example, you provide us with information when you register for an account, use the Services, record videos using the Services, or send us customer service-related requests.
Information Collected Automatically
When you use the Services, we may automatically record certain information from your device by using various types of technology, including “cookies,” “clear gifs” or “web beacons.” This automatically collected information may include your IP address or other device address or ID, web browser and/or device type, the web pages or sites that you visit just before or just after you use the Services, the pages or other content you view or otherwise interact with on the Services, and the dates and times that you visit, access, or use the Services.
We also may use these technologies to collect information regarding your interaction with email messages, such as whether you opened, clicked on, or forwarded a message. If you sign into the Services using accounts you create with third-party products and services (“Third-Party- Accounts”), such as Facebook or Google, we may collect any information that is available via your Third-Party-Accounts, such as your name, your ID for the Third-Party-Accounts, profile picture/URL, and other information available from your Third-Party-Accounts. You can generally control the information that we receive from these sources using the privacy settings in your Third-Party Account. Automatically collected information is gathered from all users, and may be connected with other information about you.
Interest-Based Advertising and Re-Targeting.
We may work with companies, including but not limited to Google or Facebook that collect information about your online activities to provide advertising targeted to suit your interests and preferences. For example, you may see certain ads on the Website or other websites because we contract with these vendors and other similar companies to target our ads based on information we or they have collected, including information that was collected through automated means (such as cookies, web beacons and other tracking technologies). These companies also use automated technologies to collect information when you click on our ads, which helps track and manage the effectiveness of our marketing efforts.

Location Information
We may obtain information about your physical location, such as by use of GPS and other geolocation features in your device, or by inference from other information we collect (for example, your IP address indicates the general geographic region from which you are connecting to the Internet).
How Does BirdieVision Use the Information Collected?
We use information we collect on the Services in a variety of ways in providing the Services and operating our business, including the following:
We use the information that we collect on the Services to operate, maintain, enhance and provide all features of the Services, to provide services and information that you request, to respond to comments and questions and otherwise to provide support to users.
We use the information that we collect on the Services to identify the users and to understand and analyze the usage trends and preferences of our users, to improve the Services, and to develop new products, services, features, and functionality
We may use the information that we collect on the Services to market our Services or third-party services to you, including by ‘re-targeting’ as further described in this policy
We may use your email address or other information we collect to contact you for administrative purposes such as customer service or to send communications, including updates on promotions and events, relating to products and services offered by us and by third parties.

When Does BirdieVision Disclose Information It Collects?

Affiliated businesses and third-party websites we do not control: In certain situations, businesses or third-party websites we're affiliated with may sell items or provide services to you through the Services (either alone or jointly with us). You can recognize when an affiliated business is associated with such a transaction or service, and we will share your personal information with that affiliated business only to the extent that it is related to such transaction or service.

With your consent: Except as set forth above, you will be notified when your personal information may be shared with third parties, and will be able to prevent the sharing of this information.
We may make certain aggregated, automatically-collected, or otherwise non-personal information available to third parties for various purposes, including: (i) compliance with various reporting obligations; (ii) for business or marketing purposes; or (iii) to assist such parties in understanding our users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through the Services.
Your Choices
You can always opt not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some of the features or functionality of the Services.

Please note that while any changes you make will be reflected in active user databases within a reasonable period of time, we may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so. We may use any aggregated data derived from or incorporating your personal information after you update or delete it, but not in a manner that would identify you personally.
If you receive commercial email from us, you may unsubscribe at any time by following the instructions contained within the email. You may also opt out from receiving commercial email from us by sending your request to us by email at privacy@birdievision.ai or by writing to us at the address given at the end of this policy.
Please be aware that if you opt out of receiving commercial email from us or otherwise modify the nature or frequency of promotional communications you receive from us, it may take up to ten business days for us to process your request, and you may continue receiving promotional communications from us during that period. Additionally, even after you opt out from receiving commercial messages from us, you will continue to receive administrative messages from us regarding the Services. Please note that if you do not want to receive legal notices from us, such as this privacy policy, those legal notices will still govern your use of the Website and the App, and you are responsible for reviewing such legal notices for changes.
Under California law, California Residents who have an established business relationship with us may choose to opt out of the disclosure of personal information about them to third parties for such third-parties’ direct marketing purposes. Our policy is not to disclose personal information collected online to a third party for direct marketing purposes without your approval. Your account is protected by a password for your privacy and security. You need to prevent unauthorized access to your account and personal information by selecting and protecting your password appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.
We endeavor to protect the privacy of your account and other personal information we hold in our records, but we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.
International Transfer
We may transfer information that we collect about you to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world.
